H.B. 1122 is going to be an interesting bill to follow. It would discontinue Iowas access to South Dakota vehicle registration information primarily used by Iowa to issue speeding tickets from Sioux Citys automated cameras. It is estimated that automated cameras pull in $4 million each year in revenue in Sioux City. There are two issues the bill raises. It seems that S.D. legislators are concerned with Iowas ticketing process. After receiving a ticket, a hearing may be requested before a Sioux City police officer, after which an appeal to a court in Iowa may be granted. At this appearance, drivers must prove innocence rather than Iowa showing he/she was driving, speeding etc. Second, there is little ticket data to show that out-of-staters honestly come by the tickets. For instance, we dont know how many tickets are issued to South Dakotans compared to Iowa citizens, or citizens of other states. Currently, Iowas cameras take pictures of South Dakota plates, and Iowa requests, and is provided, vehicle registration from our state. It seems that information sharing from criminal enforcement will continue, however, the bill will prevent Iowas access to vehicle registration for enforcement of these Iowa civil codes. Regardless of the South Dakota bill, the cameras may be taken down for other reasons. One, is the concern that the cameras violate the 14th Amendment.
