HIGHLIGHTS OF THE JANUARY 28 COUNCIL MEETING COUNCIL MEMBERS ALL PRESENT EXECUTIVE SESSION: 1. Access to Maryland Avenue Beach 2. Potential Borough Acquisition of property. 3. Contract negotiation for Shared Services. 4. Status of negotiations with TWU. REGULAR MEETING: 7:30 PM Approval of January 7, 2014 Council Meeting minutes. Approved ALL YES DEAPRTMENT HEAD MEMOS/ DISCUSSIONS: 7:35 PM 1. Open Space Advisory Committee Chair re: Risdens Bathhouse Repairs / Restoration Council was presented with background information on architectural proposals and recommendations from the committee. First step should be a structural report after sand has been cleaned out from under the building. 2. Accept resignation of James Wolfersberger fro BOA. Mayor wanted to move alternates up a position to fill vacancy. Council prefers to appoint a new member to replace Mr. Wolfersberger. Appointment held for next meeting CORRESPONDENCE: 8:03 PM White Sands requested the Council to consider amending existing ordinance to allow expansion of liquor license East of Ocean Avenue. Mayor questioned original proposal to “turn in” existing license and receive a new license under Hotel/motel exception. Both proposals are under consideration. COMMITTEE REPORTS: 8:30 PM COUNCILMAN REID: no report but several announcements. Ring ceremony at HS gym for football team followed by Installation Dinner for Chamber. Also noted positive meeting between JCP&L Tree Trimmers and Tree Shade Commission. COUNCILMAN CORTES: no report COUNCILMAN VOGEL: commented on positive meeting with Police to discuss issues of concern. Also noted request for new members by REC Committee COUNCILMAN MAYER: noted a Finance Committee meeting before Council meeting. Expecting a draft budget for next meeting on 2/4/14 COUNCILMAN GORDON: no report. Announced Beatlemania Concert sponsored by Band Parents. COUNCILMAN TOOHEY: reported on Building Dept. meeting. Town has moved up on the FEMA flood rating improving rates for PPB property owners. Proposed new requirements for new CO’s to delineate front lawn parking area to help combat front lawn parking violations. Noted 3rd Story Ordinance does not ease height restrictions. Met with environmental Commission. Main concern was for Dunes. Met with Mr. Dixon of DEP regarding potential start date for dunes ( Sept. 2014) moving south to north. Future sand replenishment could cost town 25% of bill.. MAYOR BARRELLA: noted protocol that allows Mayor to appoint professionals the first month without consent of Council, which is required after first 30 days. Has met with Republicans but no agreement on appointments. Will wait and see who is appointed next meeting ADMINISTRATOR RIEHL no report FIRST PUBLIC PORTION: 8:50 PM First resident questioned if the 3rd story ordinance had been updated since Planning Board meeting. No. Will be reviewed again by Board. Noted that driveways that are not defined are not legal driveways. Asked if there’s already a commitment to redo Risden’s. No. Waiting for structural report. Next resident opposed to 3rd story ordinance. Concerned about abuse of third story garages. Too many on street spaces being lost, especially in bungalow area. Opposite opinion voiced by next resident. Discussion about Board approval versus Council for curb cut. Board recommends, only Council can approve. CONSENT RESOLUTIONS 9:30 PM Consent 2i separated as consent # 4 . Councilman Toohey abstaining on consent 1c and 1e Councilman Vogel abstaining on consent 1c, 1e, 1z, and 2h. Consent Resolutions 1, 2, and 4 PASSED ALL YES Consent 3 HELD Appointment to BOA held for next Council meeting. Rather than move existing alternates up, Majority of Council wants new replacement for resigning member. Will wait until next meeting. ORDINANCES: 9:45 PM 2nd Reading 2014-01 (Repeal of ordinances 2013-47, -48,-49,& -50) Question to Council Vogel about why abstaining. Personal conflict. Questioned why not modify Special Events Ordinance (-47) to bring Boardwalk into compliance. No. Will revisit in in the future. Discussion about Nepotism (-48) and its definition. Mayor concerned that firm removed for using low level associates for courts will be reappointed if ordinance repealed. VOTE Ordinance PASSED. 4 ordinances repealed. Councilman Vogel ABSTAIN, Councilman Gordon NO, Councilmen Reid, Cortes, Mayer, & Toohey YES. 2nd Reading Ordinance 2014-02 (Amendment to Nepotism Ordinance. PASSED Councilman Vogel ABSTAIN, Councilman Gordon NO, Councilmen Reid, Cortes, Mayer, & Toohey YES 2nd Reading Ordinance 2014-03 ( Meeting Procedures) PASSED ALL YES 1ST Reading/ Introduction Ordinance 2014-06 (Definition of Story) PASSED ALL YES SECOND PUBLIC PARTICIPATION: Resident complimented Councilman Vogel for expressing concern about expanding liquor license East of Ocean avenue. Suggested some unintended consequences of 3rd story ordinance habitation of garage level and Council approving two cuts for a raised home.
