One country cant just say I want this person , send him to me. Countries have to respect the sovereignty, rules, laws and regulations of the other country. For example : Brazil doesnt have a conspircy Law so they do not extradite for that. HOw the U.S. government gets around that is they always throw in a money laundring or a phony drug charge some other lie to try to get the person extradited. In my case, in 1992 I qualified to become a Brazilian citizen, but at that time Brazil did not allow there citizens to have two nationalities, so to obtain nationality I had to go before a Brazilian Federal judge and sign documents renouncing my American nationality., after I received my Naturalization certificate and my Brazilian passport, I went to the American consulate in Rio De Janeiro and turned in my American passport. The consulate officer told me he already knew that I had taken Brazilian nationality because the consulate receives a copy of the Brazilian National Official Record. Then he got ugly ,he became uneducated and pissed off. And told me your still an American citizen, because only I can except a letter to renounce your citizenship, and I will not do that, you owe us money. THe next week he sent the Brazilian Interpol police to my house. They asked me is this true what they say here. What do they really want you for. I said for not paying the income tax, THAT THE I.R.S. SAID I OWED THEM AND FOR BEING ASSOCIATED WITH AN ESCORT SERVICE IN IRVING, TEXAS. They said you cant be serious. Brazil doesnt put people in prison or confiscate their property for not paying income tax. I told them that the I.R.S. even had an auction to sell off my cemetery lots in Muskogee, it cost them more to have the auction than the lots were worth. THey said O.K. we cant extradite you for the tax charge, and since Escort services are legal in Brazil, we cant extradite you for that if the escorts were of legal age, and they were all over 21 so, we cant extradite you for these dragonian laws. NOw comes the Constitutional part of the law. If you are married to a Brazilian you cant be extridited unless it is a real serious crime that Brazil gives 90 days for the country wanting you extradite you to produce solid evidence that the crime is for real and it is a serious crime like rape or murder. Second part of the law, if you have Brazilian children and support them, then you can not be extradited, the Police told me you have 2 Brazilian boys, so we cant extradite you. THe U.S. never takes in consideration the family, putting people in jail for years for crimes that most other countries did away with long ago. The U.S. will not send a nice support check each month for your family in Brazil, while you are in prison. They want to throw this respnsibility on the Brazilian government and tax payers to take care of your family for years. The U.S. has more people in prison per capita than any other contry on the planet, also, every U.S. person that stays in prison for over 5 years , 67% of their children will go to prison in their lifetime. So all the U.S. is doing is creating future criminals to support their prison system, which is costing the American tax payers billions each year. Serious crimes need to be dealt with harshly, but there is a lot of crimes that need to be taken off the books. Obama and Eric Holder has already admitted that, and are trying to do something about it. Im not an Obama fan, but these laws should have been eliminated years ago. I know one Indian fellow that was drunk and stole 3 cartons of cigarettes and is serving 20 years in prison in Oklahoma. So, Brazilians have a different outlook on this, we do everything we can to keep the families together, even give shorter prison terms, week end pass to visit your family and children, even for some citizens convicted for murder. 99.9 per cent show back up on Sunday and do not commit crimes with respect for this priviledge. When you get out of prison in Brazil you can vote, own a gun, if you were a police man before prison, you can still be a policeman. Its a live and let live society. We have Federal Senators that have been convivted of crimes that get out of prison and run for Senator again and get elected. Different mentality. THe the most important part of the Constitution , if you are a Brazilian citizen, by law, you can not be extradited for any crime, not even murder. Bill Clinton himself tried to get the Brazilian President to extradite an American that was here on a tourist visa, he had set fire to a building in Washington state for insurance money, 3 firefighters died in the fire. The penalty for that in Brazil is 10 years in prison, Washington state wanted to give him the death penalty, so the crimes didnt have the same punishment. Clinton got upset and said we will get him back one way or the other. the Brazilian president told him if he kidnapped him, Brazil would charge Bill Clinton with Kidnapping and put him on the Interpol list. The guy later made a deal with the U.S. government and went back on his own. The U.S is learning that they have to respect the laws of other countries.
