HUMAN RIGHTS ABUSE SIMPLY AND SQUARELY Where does the Federal Capital Territory Commissioner of Police Mr Joseph Mbu derive his power to ban protests in Nigeria said to be under the rule of law, from? This proclamation makes mockery of the provision of Section 1 (1)-(3) of the Constitution which is he grundnorm from where all laws are supposed to be derived from. It states that; Sec 1 (1) the Constitution is supreme and its provisions shall have binding force on all authorities and persons throughout the Federal Republic of Nigeria. (2) The Federal Republic of Nigeria shall not be governed , nor shall any person or group of persons take control of the government of Nigeria, or any part thereof,except in accordance with the provisions of the Constitution. (3) If any other law is inconsistent with the provisions of this Constitution, this Constitution, shall prevail and that other law shall to the extent of its inconsistency,be void Certainly the order of the Commissioner of Police is inconsistent with the provision of Section 40 of the Constitution,-Rights to Peaceful Assembly and Association. It is therefore ultra vires, illegal, null and void. That is why it is human right abuse,simply and squarely Given the stipulation of that law, it is his responsibility to guard the protestants to ensure that it is not hijacked by any person to wreck havoc , be he/she a terrorist, criminal or enemy combatant. Beheading one should not be made a cure /medicine for headache (Ori bibe ko ni oogun ori fifo) Since according to Daniel Webster,; God grants liberty, only to those who love it and are always ready to guard and defend it it is left for the people of Nigeria to to see to it that no overzealous, lazy and arrogant Policeman or any public official for that matter to abrogate the law. It would be recalled that this same Mr Joseph Mbu committed human rights abuse when he was the COP for River State before he was redeployed. He should be told that though there is war of attrition going on, but we have not reached the state of gestapo yet.
