Heard of a case today where an injured workers benefits were improperly suspended despite the fact that he didnt return to work after his injury- the adjustor just went ahead and filed a Notice of Suspension based on an alleged return to work without verifying the return. The attorney- who isnt a Certified Specialist like myself, and who merely dabbles in work comp- failed to recognize that he needed to file an Employee Challenge to get the benefits turned back on.
