Hello, my name is Shelley Hornby-Baaouani and this is my story. In December 2012 I married my partner of 2 years. Soon after we applied for our settlement visa for him to join me in the UK. Our visa was refused stating I do not meet the financial requirement of £18,600 per annum. This however is not correct. I am in full time employment and have been with my company for nearly 5 years and for the past 3 years my annual income has been in excess of £20,000. When applying for our visa we followed the instructions on the application form and the UKBA website. Providing the 6 months payslips and bank statements. However even though this is was is requested I later found out I should provide 12 months as my monthly wages vary. On the 9th March i gave birth to our son Rayen. My husband was not there to meet him and welcome him into the world. He had to wait 8 weeks before he could hold his child. I hired a solicitor to fight fight our appeal with us. after receiving all of our documents she could see that the decision should be overturned as I do meet the requirements asked. On the 9th May me and Rayen flew to Tunisia so he could meet his daddy. After 5 weeks it was time to leave. We boarded the plane myself crying for the pain my husband was feeling. After 3 hours we landed. I then found out my husband was still at the airport unable to drive home. Today (17th June 2013) I found out that our appeal had not been overturned and it was going to be sent to court for a tribunal. This will take around 19 weeks. By then our son will be nearly 8 months old. I am being forced to be a single parent when i am not. And this is because our government have got this wrong. I want to make you all aware. The financial requirement that came into affect in July 2012 was apparently to stop the financial burden on the UK taxpayers. However, being a non- EU my husband will not be entitled to any form of government money or benefits. Therefore would not be a burden at all. I have sent emails to my local mp, the prime ministers office, BBC news and the daily telegraph. I hope to get this public so they can see what they are doing. This is peoples lives and not games. Put your British citizens first as we are the people that keep this country going. I ask for you to like and share this page with everyone you know to help me and my son to get his daddy home.
