Here is a brief summary of what to do if you are involved in a bicycle accident in South Korea, prepared by Mark Benton. Mark ask me to post this, so that you have a better understanding of how to deal with a very possible situation. Mark has been working on this project for over a year in hand with the Ahnse Law Offices. Things you must know: 1. If you are in a crash and hurt someone then you have a potential civil and criminal liability. 2. It is possible, pursuant to the law, to “contract out” of your civil and criminal liability by coming to an agreement with the victim and paying a sum of money. 3. You must ensure that the agreement specifically “contracts out” of the liability referred to above. 4. You cannot avail yourself of this procedure if you do a runner from the accident scene. From a moral standpoint, this is probably a pretty low thing to do in any event. 5. You are entitled by law to a translator in a Police investigation. You may need to assert this right. 6. Prevention is better than cure. Ride safely. Wear appropriate clothing. Anticipate anything. If you do have a crash, stay calm, take photographs / video, get witnesses’ contact details etc. 7. Bicycles are classified as motor vehicles (the same as cars, buses, trucks etc.) under Korean law but there seems to be a lacuna in that you cannot get third party liability insurance at present (this appears to accurate as of March 2014). Be careful! 8. It may be tempting to be expedient on the basis that you assume you will come off worse but ultimately, I think you will be damaging yourself and foreign cyclists’ reputations.
