Hi Everyone, As a reminder, Halloween Trick or Treating will take place on Thursday between 6pm and 8pm. Please turn on outside lighting if you would like to see the kids in costume and provide a treat. Keep lights out if you prefer not to participate. Refuge Update: I received information yesterday that the feasibility study regarding the erection of a 32 unit apartment complex near the entrance to the Refuge has been dropped due to opposition by residents of the development. Security Issues: There have been three very recent break-ins in the Bayside development. Access was gained through rear or side doors not visible from the street. For whatever reason, this seems to be the most active time of the year for break-ins. I am sending some of the security tips that Bayside sent to residents: •Install motion sensor lights around your house. •Ensure that your homes and cars are always locked. •Remove all valuable items from plain view, i.e.GPS, cell phones, stereo equipment etc. •Place stops on windows and sliding doors. •Install dead bolt locks on hinged doors. Report any suspicious vehicles or persons that do not seem to fit in the community. I also just received information that there were several break-ins in Bayville Shores a few weeks ago, but did not receive any details. These communities are largely vacant during this time of year, but that doesnt mean that Keenwick Sound could not be targeted. As always, please secure your home and car, stay alert, and report suspicious activity. Ad-Hoc Drainage Committee Update: A meeting was held on Saturday, Oct 26. At the meeting, our legal counsels advice was reviewed. It was determined that according to our covenants, the easement area in the front of residents properties is not common area. Drainage issues should not be handled by the association unless the road surface is impacted by standing water due to a residents failure to landscape and maintain a swale so that water can drain properly. Our covenants stipulate that the easement area is to be maintaned with a swale for drainage and kept clear of obstacles that impede the flow of stormwater. Residents causing inordinate amounts of standing water on adjacent properties due to an owners failure to adhere to the covenants are legally personally liable for preventing the free flow of water through the swale area. Additionally, property owners are responsible for stormwater drainage directed to other properties via pipes, etc, that cause flooding of adjacent properties. Residents are urged to address this issue. A suggestion to add intakes to pond #2 was researched and it was found that any modifications to our current drainage plan would have to be approved by the Water Conservation District. This would require hiring an engineer to perform a study and draw up a proposal. This process would be cost prohibitive, especially since our drainage plan is grandfathered. Our drainage plan was approved prior to the more restrictive regulations became effective and a change to our current system would require that the new regulations be implemented. Since the Water Conservation District is generally opposed to modifications to existing drainage plans, we were advised that we should not pursue this suggestion as an option. The ponds were inspected and found to be in good condition, with evidence of fish spawning areas and plant growth that help maintain the health of the ponds. Residents whose properties abut the ponds are asked to be mindful of excessive nutrients, trash and debris that can affect the quality of the ponds. Please remember that decaying vegetation releases nutrients that impact the health of the pond. Based on the information presented, the drainage committee is currently in an inactive status unless the need arises to address additional concerns.
