This is example of assisgnment given in foreign universities to da student for proper understandng of law n to enhance rrsearch abilities Problem Alvin Glam is a part time student in the law school of UC and good friends with the famous pop star Lady Kabuki who he has known since he was a child. Alvin is one of a very few trusted confidants of Lady Kabuki who know that she has a mentally disabled twin sister, Carrie who lives in an institution and whom the singer supports financially. Alvin knows that Lady Kabuki is very concerned that Carrie remains out of the public eye. He has orally promised Lady Kabuki that he won’t talk about Carrie publically. In Alvin’s spare time he operates a website LadyK.au which contains a variety of multimedia material about the artist. The site is very popular and Alvin makes a good living from selling advertising space on the site. The site’s success is in part due to the fact that Alvin has been able to write many articles based on exclusive interviews given to him by Lady Kabuki together with photographs supplied by her for use on the site. Note: These photographs have been previously commissioned by Lady Kabuki from the famous photographer Patrick De Salvatore for a large sum of money. In January 2012 Alvin secures an e- book publishing deal with Electric Publishers to write a “no holds barred” biography of Lady Kabuki called “Angel Voice” which is also the title of Lady Kabuki’s most successful album. The book is published in December 2013. In the book Alvin tells the story of Lady Kabuki’s journey from small town Canberra school girl to international pop phenomenon. Alvin has spent many long hours at his computer extensively researching the book on the internet. As well as being able to draw his own interviews for details of Lady Kabuki’s life, he obtains a lot of factual material from other public internet sources such as Wikipedia and Hello. In addition, the book includes the following material: 1. The first verse from Lady Kabuki’s most famous songs, which appear at the beginning of the first chapter. The verse is as follows; “Oh Angel voice don’t ever leave me Angel voice in my memory Ten thousand wings” 2. Photographs of Lady Kabuki commissioned by her from Patrick De Salvatore and which have been previously published by Alvin on his website 3. Details of Lady Kabuki’s relationship with her disabled twin sister Carrie including the name of the institution on which she lives and the fact that Lady Kabuki supports Carrie financially. When Lady Kabuki reads the book she is enraged. She instructs her Lawyers Slime and Bucket to write to Alvin threatening legal action if the book is not removed from sale immediately. Alvin has come to you for legal advice on these matters In this assignment you must advise Alvin on the legality of his e-book Angel voice. Can Lady Kabuki (or anyone else) take legal action against him in respect of the book’s contents?
