Houston reducing penalties for marijuana possession Local law enforcement officials in Houston and Harris County announced a new policy this week that will reduce the number of marijuana offenders facing criminal prosecution. Individuals accused of possessing two ounces or less of marijuana could still be arrested and booked, but charges would be dropped if they complete a diversionary program. The new policy takes effect on Monday. Currently, a conviction for simple possession of marijuana carries up to six months in jail and a fine of up to $2,000. The change in Harris County comes amid a political race for district attorney in the conservative Houston area. Both the incumbent and challenger for the position support a program to prevent criminal prosecution for simple possession. According to a poll conducted by MPP in late 2013, 61% of Texas voters supported removing criminal penalties and jail time for those found with marijuana. “While the policy falls short of true decriminalization, the move represents an important step in Texas,” said Heather Fazio, Texas political director for the Marijuana Policy Project. “The fact that both political candidates for the district attorney position are each taking credit for decriminalizing marijuana possession shows they are responding to the wishes of the majority of voters.” MPP is now working with key legislators to introduce legislation next session that would remove all criminal penalties and the possibility of arrest for those in possession statewide.
