My dear Friends, A.O.A., As I hate to waste your time, I immediately come to the THREE points I want to make. 1. According to Health Department Punjab order dated 13th june,2001, Dr. Khalid Mahmood was proceeded against under provision of Punjab Civil Servants(E&D)Rules1999 on the charge of misconduct i.e willful absence from duty w.e.f. 11.11.1999( This date is FAKE. The date in the chargesheet is 31.12.1998/ non- compliance of transfer order dated 31.12.1998) Furthermore the Secretary Health himself admitted THIS FACT( Probably TRUTH slipped out) when he wrote on April03, 2009 - in compliance of the orders of honourable L.H.Court, Lahore. I quote, Dr.Khalid Mahmood was proceeded under PCS(E&D) Rules1999, on the charge of willful absence from duty w.e.f. 11.1.1999. FOR THE ALLEGED MISCONDUCTi.e non - compliance of transfer order dated 31-12-1998, I was punished by SHAHID HUSSAIN RAJA, Secretary Health Punjab on 13-06-2001, under PCS(E&D)Rules 1999 which came into force on 21.06.1999 i.e about six months after the alleged misconduct occured. It is SETTLED PRINCIPLE according to CONSTITUTION: Rules/Laws do not have retrospective effect. So proceeding against Dr. Khalid Mahmood under provisions of PCS(E&D) Rules 1999 is UNLAWFUL and accordingly the 13-06-2001 Dismissal Order is ILLEGAL AB INITIO( from the beginning - since birth) and appeal against ILLEGAL AB INITIO orders is never TIME BARRED. 2. In Health Department Order, the Secretary Health Punjab SHAHID HUSSAIN RAJA, imposed major penalty of Dismissal from Service upon Dr.Khalid Mahmood under Rule 4 (1) (b) (iii) of PCS(E&D) Rules1999 which is Compulaory Retirement and NOT Dismissal from Service - again making the Dismissal Order illegal from the beginning - since birth - ILLEGAL AB INITIO and APPEAL AGAINST SUCH ORDER IS NEVER TIME-BARRED according to CONTITUTION. 3. The honourable Lahore High Court has/had already directed the Departmental Authority to decide the Departmental appeal of the petitioner within four weeks. Futher as stated above the Dismissal Order is ILLEGAL AB INITIO - - the mistake has to be corrected for the good of NOT ONLY Dr.Khalid Mahmood BUT ALSO for generations to come, in the interest of justice. The Dismissal Order is illegal ab initio - illegal from the beginning - since birth. 2. Ali Hammad told me on December25,2008 that Manzer HIMSELF admitted that he i.e, MANZER was behind my dismissal BECAUSE OF AN INCIDENT which occured in Bahawalpur in 1992. Details of that incident are in my application. 3. Ali and I have been in touch since May,2007 - when he was kind enough to come to Bahawalpur to see what I was going through. Ali Hammad CATEGORICALLY said face-to-face as well as on phones that: Manzer Hayat and another CSP classfellow of ours who is in FOREIGN SERVICE are VERY CORRUPT PEOPLE. 4. According to Prof. Dr. Abdul Manan Baber as well as more than hundred other very educated persons- most of whom are DOCTORS or Abdalians- this application of mine is VERY WELL WRITTEN and COMPREHENSIVE. 5. High Court, Lahore has declared my REQUEST REASONABLE.6 6.
