I am searching for the proper metaphor to illustrate just how disastrous a move it would be for the SCOTUS to destroy the ACA on a legal technicality and the only example that comes to mind is the 1861 bombardment of Fort Sumter in Charleston Harbor. The civil war comparison is sadly entirely appropriate. Americans will quite literally die if the rightwing justices deny them access to healthcare and the immediate result of a ruling finding government subsidies unconstitutional would effectively allow the Republican South to secede from national healthcare reform leaving millions of low-income people in the lurch and scrambling to come up with alternative solutions which GOP controlled state legislatures wouldnt dream of providing. The first and most serious casualty would be the legitimacy of the Supreme Court itself. How could Americans in good conscience abide by decisions handed down by a shadowy cabal so transparently complicit in partisan hackery? I dont see how the Union could withstand such a shock to the system. Once the highest court in the land starts making war on the people there can be no pulling back from the abyss. Chicanery is one thing but judicial murder is quite another. It doesnt matter whether you kill citizens by shooting them in the head or by denying them access to life saving treatment; the outcome is the same. If the judicial branch of our government is nothing more than an artificial limb remotely controlled by oligarchs and talking heads on Fox News then the experiment in democracy resulting from the American revolution has failed and vicious anarchy rules. I dont know whether Chief Justice John Roberts wants to live in infamy as the man who wiped the United States of America off the map. I guess well know soon enough.
