I dont see how this would ever stand a legal challenge. As Canadians we have a right to be treated equally before the law. That also means/implies that civil law is the same for all Canadians. The Code of Service Discipline is distinct from civil law in that the discipline required during war and in service in general is necessarily more strident than in society at large. But that does not mean that a soldier who falls short of military discipline is a criminal. This proposed amendment is bullshit and will be shredded by real lawyers the second some Military ambulance chaser tries to impose a criminal record on a guy for telling some higher rank to get stuffed.
