I had a PCMH last week which we needed to move the day before it was listed (as my trial was running over and I could not attend). This was a case where I had represented the defendant before and he had specifically asked for me upon his more recent arrest. My involvement in the earlier proceedings was undoubtedly of benefit in ensuring a speedy resolution to the case! When the court was asked to move the hearing back to the following week they refused. Reason? An interpreter was booked for the hearing, if the court vacated the hearing with less than 24 hours notice they were obliged to pay for the cancelled interpreter (even if the same interpreter would be attending on the adjourned date). The case remained in the list and I had to return it! So when interpreters dont turn up - no sanction for them but we dont get paid. When we want to cancel, they still get paid and we lose out. This system has gone to the dogs!
