I had lost track of this case but was wondering what had happened with it. I like Judge Roger Gregory, 4th Circuit Court of Appeals, who included in the majority opinion, We take heed of his warning and are therefore unwilling to relinquish our First Amendment protections—even in an airport. Stories indicate there was no monetary payment in the settlement but the scanners are gone. The kids argument in the beginning was the scanners, so he got what he was after. Personally, I think sanctions against government agents stepping across and flagrantly violating specifically enumerated Constitutional protections should be harsh and severe. This wasnt an oops where things just went bad and sorry about that. This was a purposeful and retributive attack against the gall of a citizen daring to exercise their Constitutionally guaranteed rights. The gall to do it where protesting is specifically allowed by RIK policy and practice. And the gall for a male to dress down to what by matter of right or custom would be acceptable for a male in public; actually dressed more than the larger than life advertisements in the very same area. I still think he should have been paid in the settlement. The fact that a Circuit Court had to get involved and that it still had a dissenter in such a clear case of a 42US;1983 action.
