I need some input from fellow MTs and I am hoping someone on this forum will be able to point me in the direction of some real answers... I began working for a local massage therapy clinic in March. When I began the job, i was told I was needed to be available on weekends. Having 4 kids, it was a hard decision, but i have been managing to work at least saturdays. I then got a new job at a chiropractors office. I am the only massage therapist working at said chiropractor right now and i am now needed there on weekends. I was under the impression that as an independent contractor, i make my own hours. When I told my boss at the first job that I would need saturdays off for my new practice, he REFUSES to take me off his schedule for weekends.He followed up by booking me at least 2 massages per saturday throughout the entire month of august. He also docks paychecks for Groupon/Living Social/Amazon Local ads, which literally chops my paycheck in half. I am on call for same day appointments as well. Can anyone tell me if this is legal? Is it legal for him to not allow me the days off that I request? Is he allowed to dock paychecks that much? Is it legal for me to be on call? I have heard others saying it isnt. If not, could anyone send me a link to any site that would tell me so?? Thank you for the feedback in advance!
