I received this from an attorney who is going after Insurance Companies who have doctored engineering reports on Flood Claims. If you are one of them please contact this attorney. Dear Sandy clients, The flood cases • We suspected that in some of the Sandy cases the flood insurance companies were changing engineer’s reports to avoid paying flood claims. • In these cases, engineers hired by the flood insurance companies concluded that the damage was caused by flood. • The insurance company changed the report to conclude the damage was not caused by flood. • The altered report said the damage was caused by “long term differential movement of the supporting soil” • In other words, the house settled and the flood water from Sandy had nothing to do with the damage. • A hearing was conducted in federal court. • The engineer was cross examined on the stand. • The fraud was revealed. • The court sanctioned Wright National Flood Insurance and their attorneys. • U.S. Magistrate Judge Gary Brown called it “reprehensible” and “widespread” practices aimed at preventing homeowners from getting fair consideration for their claim. • While this was just one insurance company (Wright National Flood) we believe many of the other flood carriers are doing the same thing. • Judge Brown ordered all the flood insurance companies (about 50 companies) to turn over all drafts of engineer’s damage reports on all of the Sandy flood cases in litigation (over 1,000 cases). • This will allow our team and other homeowners attorneys to review the drafts of hundreds of damage reports to find out if other reports were changed. What can you do? • If you know of a flood inspection report where the conclusion was changed (i.e., report #1 said flood caused the damage and report #2 said flood did not cause the damage) please let me know. • This includes homeowners that are not part of the Sandy litigation, homeowners who never filed a lawsuit • Some homeowners received fraudulent reports, had their flood claims denied and didn’t pursue the issue further. Please let me know if • your house was inspected by any of these companies: US Forensics, HiRise Engineering or Haag Engineering • the report concluded your damage was caused by “movement of the supporting soil” or “settlement due to consolidation of soil” • if so, you may have been defrauded by your flood insurance company • this includes all homeowners with flood insurance whether or not you are part of the Sandy litigation.
