I spoke several times today to both the Dept. of Labor as well as people in Eileen Carrolls office. Needless to say, everyone is in and out of meetings, as they try to decide how best to handle the decision that was handed down by Federal Court in the District of Columbia yesterday. I conveyed all of the confusion, the stress of uncertainty that the majority of us are feeling right now. This was perfectly timed and orchestrated in my opinion by the plaintiffs and does not make for happy holidays for many of us. We have worked long and hard toward gaining overtime, an entitlement that the majority of people in the workforce automatically enjoy! This was a step in the direction of becoming recognized as a viable work force entity, one of the fastest growing sectors in the country as well as one of the lowest paid, who deserves the same benefits and rights as every other working individual. I was asked to convey to have a few more days of patience as both the Dept. of Labor as well as the state and the Brown Administration figure out how best to handle this unexpected debacle. County notices will go out as soon as these parties come to a decision on how best to move forward. I was advised that we should keep doing what we are doing and that is to plan on the DOL final rule being implemented on Jan 1st until we are informed otherwise. All the various speculation that has transpired here among us since the decision was made public, while important to each of us, will have little to no bearing until we hear what both the federal government and the state decide what they are going to do....and what our options are. I wish I had been given something more definitive to pass along, but rest assured all parties are working on this....it is just that the impact it will have on us as providers and the consumers we care for is still unknown!
