I think the ICC should be careful, even as it says it is seeking justice for victims of election violence, not to make victims of all of us Kenyans. Justice should not be abstracted from the wider context of the needs and rights of a whole nation. The court should also try to make it easy for suspects to comply with orders and summonses. I know the law says all suspects are equal. But are they? Some are presidents, some are warlords others are former presidents. Their diaries and responsibilities are different, I should imagine. The fact of the matter is that our President and his Deputy are ICC suspects. It is not a good idea for us to have both of them away at the same time. The ICC should not be so absorbed in its own rules, powers and so on to the extent that it forgets the interests of the people it claims to act for. In any case, Mr Kenyatta, Mr Ruto and Mr Sang are innocent until the conclusion of their trial. (Remember Mr Muthaura, Gen Ali and Mr Kosgey?)
