I think this is an interesting issue. Certainly, if he had sent a letter, a text, a private message, etc directly to his ex, then it would be very easy to say that his speech constituted a threat. But if he is simply venting on his own page, I think it is less clear. I think this case is in the position to set a very clear precedent, which is consistent with 21st century technology. While one does not have the right to threaten someone, do they have the right to post their own rants/venting, etc online, which his ex may or may not even read...and which may or may not threaten her directly. Im not going to say that everything I read on line is necessarily appropriate (on most forums or comment sections, I often read bigoted remarks, or hateful comments), but to set a tight standard is to create a slippery slope towards controlling ones free expression of thought, IMHO.
