IDEA provides a sequence of event/procedures that the district and the state are obligated to perform in order to determine if a child meets the criteria for specially designed instruction. Third the Determination of Eligibility Process, describes what this procedure is and how the "team" determines eligiblity idea.ed.gov/explore/view/p/%2Croot%2Cregs%2C300%2CD%2C300%252E306%2C Fourth the IEP Development by the Team idea.ed.gov/explore/view/p/%2Croot%2Cregs%2C300%2CD%2C300%252E324%2C All of the procedures listed above determine who, when, who, and why must be done in order to determine if a child needs an IEP, if the Child meets the IDEA criteria for a disability, and what will the services be exactly. These regulations mandate how the district is supposed to implement the process. It is not dictated by the school district or the Sped Dir or even the State Special Ed. Dir. and if they do not adhere to the specifics of the process, they could be Denying FAPE to your child.
