If guilty, do you believe in this form of shaming punishment. This would be deemed cruel and unusual punishment by most of the justices (liberal side would argue its cruel and unusual punishment, since in the modern world this is not considered acceptable by our modern standards. Some on the conservative side would look to the founders and say that this was accepted at time of founders or not deemed cruel or unusual at that time -and let the shoe slap begin. I assume Scalia would be willing to join in on the shoe slap - I would volunteer all my shoes). Lets assume the punishment is only - hitting the men in public with a rubber shoe and yelling nasties at them while naked. Lets assume no serious injuries.
