Im NOT going to debate whether the Affordable Care Act, a.k.a. Obamacare is good or bad. This is NOT a political post, I love all my friends and family from all political spectrums. Here is my question: Does the President have the authority to even do the legislative fix he outlined yesterday? The pundits are all talking about the pros and cons of his Executive Order. However, the first thing that occurred to me was the Separation Doctrine of the Constitution. I was not aware that we now have a line-item veto allowing the President to selectively enforce certain provisions of a particular federal law for certain periods of time. This is in effect creating new law, and the President cannot do that. That power is reserved for the Legislative Branch. All my Facebook friends, lawyers and non-lawyers alike, please weigh in. Am I wrong?
