In 2006, the City hired Steptoe & Johnson to write a legal opinion on enacting an ordinance to regulate truck traffic in the Downtown Business District. Their conclusion? A COURT WOULD LIKELY DETERMINE THAT THE CITY HAS JURISDICTION TO REGULATE TRAFFIC ON THE PORTION OF WV ROUTE 7 THAT PASSES THROUGH THE MUNICIPAL BOUNDARIES OF THE CITY. It further states: (1) Municipalities have jurisdiction to regulate traffic on state roads through town. (2) Federal preemption would not likely prevent the City from enacting an appropriate ordinance. The legal advice provided to the City in 2006 is CONSISTENT WITH the Safe Streets Morgantown proposal.
