In Sherwood v Walker, 66 Mich 568 (1887), the parties contracted for the sale of a cow named Rose of Aberlone, believing that the cow was sterile. The parties later discovered that the cow was pregnant, and the contract was voidable on the ground of mutual mistake of fact. In January 2012, the Detroit Tigers and Prince Fielder entered into a nine-year contract worth $214 million, certainly with the mutual understanding that Fielder would at least try. Hmmm.
