In aland mark judgement on shariat court the apex court of India has observed that shariat court which is meant for the muslim has no legal validity.The fatwa issued by such court is not binding upon muslim.How ever , the supreme courtdenied to impose any restriction on shariat court.It is upto the muslim to obey or not to obey. No law of the land has approved it.Further his lordship C.K prasad, observed that some times the ruling ofshariat court is violative of human right. The innocent ispunished. A basic legal maxim says(let hundred accused go unpunished,but an innocent should not be punished)No one can force a person to obey fatwa,Because is violative of fundamental rights. Fundamental rights is the bedrock of democracy.If fundamental rights are violated ,they can be enforced in proper court of law.
