In continuation to Post by Respected Madam Manju Mishra IF TIMELY ACTION WAS TAKEN AGAINST THE CULPRITS BY THE PNB MANAGEMENT, SAD DEMISE OF COM. AJAY SEHGAL CHIEF MANAGER PNB NEVER HAPPENS : I had made complaint against the two great criminals namely J.K.Gupta (while he was DGM/CH Patna Circle of Punjab National Bank & A.K.Gupta (the then AGM Circle Office Patna) and his 03 chamchas (conniving & abetting with them) to PNB HO PAD, CVO, all the 03 EDs & CMD vide my representation dated 06.10.2011, 15.12.2011, 02.02.2012, 25.02.2012, 29.02.2012, 04.03.2012, 10.03.2012, 09.05.2012, 20.05.2012, 21.06.2012, 18.08.2012, 16.10,2012, …………., 21.05.2013, 05.08.2013, 08.08.2013, 24.08.2013, 03.09.2013, 19.09.2013, 01.11.2013, 05.12.2013, 07.01.2014, 16.01.2014, 25.03.2014, 31.03.2014, 01.04.2014 & 20.04.2014 for their involvement in criminal conspiracy, abuse of authority, vexatious & treacherous approach and misuse of power; but the authorities are unnecessarily protecting the persons involved in criminal conspiracy (committed offence under Section 120-B of IPC), disobeying law by public servant – with intent to cause injury to another person under abuse of authority by grossly violating the Bank & CVC guidelines (committed offence under Section 166 of IPC), Framing incorrect document by public servant with intent to cause injury (committed offence under Section 167 of IPC), furnishing false information (committed offence under Section 177 of IPC), false information- with intent to cause public servant to use his lawful power to the injury of another person (committed offence under Section 182 of IPC & also offence involving Moral Turpitude) and grossly violating the Principles of Natural Justice [The cardinal rule among the different rules of Natural Justice is that “No one shall be condemned unheard”. An order affecting the rights of a person or having adverse consequences on him should not be passed without affording a hearing to him]. Under departmental action all the culprits involved in the conspiracy have committed offence under Reg. 3(1), 3(2), 3(3) & 3(4) read with Reg. 24 of the PNB Employees’ (Conduct) regulation, 1977 which is punishable under Reg.6 of PNB Officer Employees’ (D&A) Regulation, 1977 for their misdeed during their stay at PNB CO Patna.. It was time and again requested with the top authorities since > last 2 ½ years regularly that “A thorough probe be conducted by Chief Vigilance or some other senior officials to go into the details of working of HRD/GAD/Law Section at Circle Office Patna where HO/RBI/Govt./CVC guidelines are being knowingly and intentionally violated. It is not restricted in transfer and posting of officers only, they are managing & manipulating the facts & findings in all sorts of affairs as per their suitability and vested interests. It is extremely needed sir, to promote transparency and accountability in the working of CO Patna, containing corruption. The culprits tarnishing the image and reputation of our esteemed organization are severely punished for demonstrative effect.” But it seems that my request has not been adhered to yet because the authorities had preferred not to communicate any reply to me as to what action they had taken against the corrupt officials. On my six complaints to Central Vigilance Commission, the CVC had examined the matter & instructed the CVO PNB for taking necessary action vide their letter reference no. : (i) Complaint No. 24017/2013/vigilance 3 sent to CVO PNB for necessary action on 04.09.13; (ii) Complaint No. 24219/2013/vigilance 3 sent to CVO PNB for necessary action on 11.09.13; (iii) Complaint No. 32451/2013/vigilance 3 sent to CVO PNB for necessary action on 09.01.14; (iv) Complaint No. 0394/2014/vigilance 3 sent to CVO PNB for necessary action on 04.03.14 ; (v) Complaint No. 0471/2014/vigilance 3 sent to CVO PNB for necessary action on 16.01.14 & (vi) Complaint No. 2947/2014/vigilance 3 sent to CVO PNB for necessary action on 04.03.14 . But what action CVO Mr. Shiv Kumar Gupta has taken against the culprits has never been communicated to the complainant i.e.me. It is smelt that Joginder Kumar Gupta & Ashok Kumar Gupta both the criminals have managed the CVO & the CMD. On my two complaints to GOI Cabinet Secretariat (Directorate of Public Grievances) : (i) They vide their reference No. DPG/B/2013/00271(2) NBPNB has sent my complaint dated 24.08.2013 to Secretary (FS) Department of Financial Services for examining the issue and taking necessary action vide letter dated 17.09.2013; (ii) They vide their reference No. DPG/B/2014/80191(2) (NBPNB) has sent my complaint dated 21.04.2014 to Secretary (FS) Department of Financial Services for taking necessary action vide letter dated 24.04.2014. The outcome of the ATR (action taken report) is not yet been released against the culprits. On my two complaints to GOI Department of Administrative Reforms & Public Grievances : (i) They vide their reference No. DEABD/E/2013/03987 dated 11.08.2013 has sent my complaint dated to PNB Authorities for taking necessary action ; (ii) They vide their reference No. DEABD/2014/01867 dated 21.04.2014 has sent my complaint dated 21.04.2014 to PNB Authorities for taking necessary action. The outcome of the action taken by PNB is not yet been released to complainant against the culprits. It is presumed that management is protecting the culprits, reason better known to them. The NMC & NHRC has also taken up the matter with the CMD but they have been misrepresented & misreported about the facts by the DGM PAD HO Mr. R.D.Kailey. Since I was abroad for 1 ½ months and now on returning back to India I came to know about the facts. I am taking up the matter again with them with documentary evidences. The Consumer Complaints Redressal Council (India) has also taken up the matter vide their reference No. 0006240/2013 & 0007144/2013 on my complaints with the bank but the bank has not yet communicated the action taken against the culprits (the criminal conspirators & offenders) to the complainant. Madam Manju Mishra in her post dated 15.07.2014 has rightly observed that “IF TIMELY ACTION WAS TAKEN AGAINST THE CULPRITS BY THE PNB MANAGEMENT, SAD DEMISE OF COM. AJAY SEHGAL NEVER HAPPENS”. It is time for the Association both AIBOC as well as AIBOA to contribute their mite for the cause of humanity & JUSTICE.
