In the appeal of Latta v. Otter at the 9th Circuit, the state of Idaho had asked the Court to hear their case en banc instead of the usual panel of three (in most federal courts of appeal, an en banc hearing means all judges hear the case at the same time; the 9th Circuit is so large, however, that en banc hearings are assigned rather to panels of eleven judges). The 9th Circuit has denied this request, so the case will proceed as usual before a three-judge panel. After that panel rules, the decision can still be appealed to an en banc hearing again, or it can be appealed directly to the U.S. Supreme Court. Oral argument is set for September 8.
