In the name of Allah the most Gracious most Merciful A statement from the families of the following detainees who were sentenced to death in the (fabricated) military case of Arab Sharkas (No. 43/2014): 1. Ashraf Ali Ali Hassanein Algharabaly, 2. Mohamed Bakry Mohamed Haroun, 3. Hany Mostafa Ameen Amer Mahmoud, 4. Mohamed Ali Afifi Badawy Nasef, 5. Abdel-Rahman Sayed Rizk Abou-Srei, 6. Khaled Farag Mohamed Mohamed Ali, 7. Islam Sayed Ahmad Ibrahim, 8. Ahmad Abou-Srei Mohamed Hassanein, and 9. Hosam Hosny Abdul-Latif Ali. The first of these defendants is a fugitive. Official documents were presented regarding the second, third, and fourth defendants proving that they had been held at Al-Azouly Military Prison since November and December of 2013 and until the time of the Arab Sharkas incident in March of 2014. There, they were subjected to severe torture and pressure to admit to crimes they did not commit. Mohamed Bakry had slipped into a coma for a while as a result of severe torture, and the effects of torture on him are still apparent. Hany Amer’s shoulders had been broken, among other similar injuries, and he was not even able to feed himself without assistance. There is not a single piece of evidence against the fifth, sixth, and seventh defendants; they were arrested in public places far from the location of the incident, and the security equipment video recording of this incident, from the beginning of the intrusion to the death of those who carried it out at the hands of security forces never showed any sign of these defendants. They too were subjected to severe torture and pressure to admit to crimes they did not commit. As a result, Khaled Farag’s left knee was shattered and his right thigh was broken; they indicated that if he did not sign, admitting to what they wanted, they would break his right leg and he would remain invalid on a wheelchair for the rest of his life. Khaled underwent knee surgery at the Torah Prison hospital. Much of what was shattered was removed and 7 screws were inserted into his left leg; all this is documented in an operating room report at the Torah Prison. The eighth and ninth defendants have not been sentenced up till now, although the state security officer who was (allegedly) responsible for the investigation was asked about them, and he admitted that they had had no role in this incident. Despite all that, defendants number one through seven were sentenced, and their official documents were presented to the Mufti (who has the final ruling on death sentences) after only 9 sessions, including preparatory and procedural sessions and only one session for pleading and listening to the only witness in the case. All documents and evidence indicating the innocence of some of these defendants were ignored, and the others were sentenced without evidence, causing severe shock and intimidation to the families of the detainees and those around them who were not accustomed to such harsh judgments and total disregard for the lives of innocent people. In addition to refusing to recognize any confession made under torture or coercion, we strongly condemn the practices of the military courts, which did not give the accused a chance to defend themselves, while the state security officer, the only prosecution witness, had full freedom to launch his lies and totally unacceptable fabrications. All this proved beyond any doubt that these verdicts were prearranged and predated the fabricated case before a highly politicized judiciary, which received its orders from its supreme leader in collusion with security forces in order to get rid of the finest young men and Egypt. We reject and strongly condemn these unfair judgments and call upon all accomplices to examine themselves, return to God, and repent from this farce. The Messenger of Allah peace be upon him said: Judges are of three types: two judges in Hellfire and one judge in Paradise. The judge who knows the truth and is deliberately tyrannical in his judgment is in Hellfire; the judge who rules without knowledge is in Hellfire; and the one who knows what is right and gives judgment accordingly will go to Paradise. God Almighty has vowed to destroy the wrong-doers and to punish them in this world and in the Hereafter: “Thus does your Lord punish unjust nations; truly His punishment is painful and severe.” [Surat Hud, 102.] As for us, we put our trust in God; He is the trustworthy Guardian and Supporter, and He is sufficient for us and the best of Trustees.
