Invoking Colonial Law To Jail Independence Children Of Kenya Must Be Resisted By Sweat And Blood. One university student was jailed for two years under very questionable circumstances. Two opposition figures, Dikembe Disembe and Robert Alai Onyango-who expresses open dissatisfaction with Jubilee government, have their cases in court. The government can’t wait to throw them in jail. But we will resist. Thank God they have articulate legal representation. Don’t be surprised if they come for you or me using the same old draconian law that was initiated by colonial government to brutalize and murder our founding fathers that fought for the independence President Uhuru Kenyatta and his deputy Willian Ruto enjoys today. I can’t believe this draconian law is still in existence in our justice system. Our lawmakers are sleeping on their job. Established in 1930, the penal code 132 on undermining authority of public officer states: “Any person who, without lawful excuse, utters, prints, publishes any words, or does any act or thing, calculated to bring into contempt, or to excite defiance of or disobedience to, the lawful authority of a public officer or any class of public officers is guilty of an offence and is liable to imprisonment for a term not exceeding three years.” Interpreted in its immediate context, this law dictates every single Kenyan to praise the government even when it is doing wrongs and praise leaders even when they are engaging in corruption and exclusive governance. Speaking against government excesses and its official’s impropriety is tantamount to a jail term. Ladies and gentlemen, this law must be amended to reflect our growing freedom and democracy. Don’t you think so?
