Ipca Labs, Lekar Pharma force NPPA to hike prices of 2 formulations (P. National Pharmaceutical Pricing Authority (NPPA) has been forced to review and hike the prices of two formulations -- pyrantel pamoate and metronidazole benzoate+norfloxacin- after a long process and on the basis of the order by the Department of Pharmaceuticals. Ipca Labs has filed and fought for the review in case of pyrantel pamoate suspension 10 ml bottle, against the price fixation order by the NPPA dated July 1, 2011while Mumbai-based Lekar Pharma Limited sought the review of the NPPA order with regard to scheduled formulation metronidazole benzoate and norfloxacin suspension 30 ml. “In implementation of directions given in line with review order passed by the Department of Pharmaceuticals on 22.3.2013 in respect of S.O. No. 1513(E) dated 01.07.2011 for pyrantel pamoate suspension, fixing the prices of pyrantel pamoate formulations, the matter has been reconsidered and re-examined by the NPPA,” the notification by the regulator said. Accordingly, the MRP (inclusive of all taxes) for pyrantel formulation of 10ml glass bottle with M.cup and carton has been now hiked to Rs.12.67. According to the previous order of July, the price was fixed at Rs.11.76 by the NPPA. In the case of the other formulation pack of metronidazole + norfloxacin suspension (30ml Pet Bottle with M. Cup), the new price is Rs.12.54. As per the earlier order, dated December 12, 2012 which was challenged by the company, the MRP was Rs.12.15. The pro-rata pricing for packs of same composition but of different sizes will be applicable for tablet and capsule packed in strip or blister. In its review order dated March 22, 2013 on the petition by Ipca Labs, the DoP had asked the NPPA to revisit the case and take action. “NPPA should not use non-notified prices except as explicitly provided by the guidelines. Guideline 1/99 – Sl.No.1(b)(ii) provide that where there are no notified prices the prices claimed by the formulator supported by purchase document are taken as the basis. NPPA may be directed to use these guidelines for Amber colour bottle and Xanthum Gum because NPPA has not been able to show either the notified prices or any other guidelines,” the order said. “If price allowed to one company has to be applied to the other, they should invariably be notified before such application. Otherwise the existing guidelines 1/99 Sl.No.1(b)(ii) should have been strictly adhered to. Correct rate for pharma grade sugar should be applied for unless there is any other reasons to apply normal grade sugar,” as per the order. AZAD JAIN
