Ive been trying to get my thoughts in order about the Hobby Lobby ruling. First, I think its a bad ruling. The reasons for this are many, but mostly come down to personal philosophy, so Ill leave that part out of the equation. The biggest problem is that weve lost sight of what a corporation is. A corporation is a legal entity that is separate and distinct from the owner(s) of that corporation in order to protect those owners from some or all personal liability. If a corporation does something wrong you can sue the corporate entity but not the CEO or the board or the company founder. But now were saying that a company has rights based on the rights of the companys owners. Im fine with this, as long as we eliminate the corporation and make the owners take all legal responsibility for the companys actions. As my friend John Shine put it, corporation owners should not be allowed to have their cake and eat it too. Either corporations are a separate entity or they are their owners in a real and legal sense. You cant have it both ways.
