James Madison said - “The powers delegated by the proposed Constitution to the federal government are few and defined. Those which are to remain in the State governments are numerous and indefinite. The former will be exercised principally on external objects, as war, peace, negotiation and foreign commerce. ... The powers reserved to the several States will extend to all the objects which in the ordinary course of affairs, concern the lives and liberties, and properties of the people, and the internal order, improvement and prosperity of the State.” It should be self-evident that if we are going to have a Federal government that is going to be able to control the numerous and indefinite power of the States, as the 14th Amendment sets up, then the powers exerted by the former must exceed those of the latter and Madisons concept is no longer operative. Hence, we find in section 5 of the 14th Amendment that Congress has power to enforce its dominion over the people, both personally and in their body politics, by whatever is appropriate, and whatever is appropriate under Article 1 Section 8 is whatever is necessary and proper to accomplish those ends. Our original system is still there, its just nobody wants that anymore - they seem to view the Federal usurpation, sustaining the inverted citizenship of section 1 of the 14th Amendment as a great thing, in turn, few seldom correct themselves of that and reclaim their original status under Article 4.
