Jeff Tucker is way, way, way overthinking this: With laws against DUI, what’s being criminalized? Not reckless driving as such. Not aggression against anyone. What’s being criminalized is the chemical make up of the blood in your body. That itself should be no crime. To make having a certain blood content illegal is essentially totalitarian. Ignoring the juvenile comment about totalitarianism -- If you want to approach this situation really abstractly, I guess thats true. But there is already is an implicit drive-at-your-own-risk aspect to the law, and it is simply inherent to the nature of the situation: If you really are good to drive, no policeman is going to suspect you of being under the influence -- even if you really are over the legal limit. If you can actually drive well under the influence, then go ahead and do it, and nobody will be the wiser. If you cant, then youll be caught, and you really *ought* to be punished for making such a reckless decision.
