John LaRue, formerly of Helena, has been acquitted on all charges of nearly shaking an infant to death in a Lynchburg, Virginia, court case. LaRue was acquitted last week of aggravated malicious wounding and child endangerment, which stemmed from injuries to a 16-month old girl he was babysitting in 2009. According to court reports, LaRue was accused of being frustrated with the girl after she wouldnt quit crying. Juliana Thaxton is now five years old; she is blind, cant walk or talk, and will never be able to. Her mother Jolene Booth says shes devastated by the ruling, which came after LaRues wife didnt have to testify due to marital privileged immunity. Booth said, I was very disappointed about the outcome. Its obvious we fought for this for four years. We wanted that day in court to be able to tell the truth and for the individuals in the courtroom to hear how severely my daughter was abused. Hopefully another child will be protected from this kind of injury, thats certainly more important than a guilty verdict. But today my daughter, she cannot walk still, she is still blind, she is tube fed. And shell be that way for the rest of her life. According to reports by another news source in Virginia, the judge said that only John and his wife will ever know what really happened to Juliana. Booth said despite the ruling, she hopes good will come out of the publicity regarding shaken baby syndrome.
