Just what the Bill of Rights needs: a rewrite!... Retired Supreme Court Justice John Paul Stevens has written a new book on how we could improve America if we’d just rewrite half a dozen pesky Constitutional Amendments to fit his dissenting minority opinions. In an advance excerpt in the Washington Post, Stevens says he’d “fix” the Second Amendment by making the right to own guns apply only to state militia members. Stevens argues that for the first 200 years of our nation, that’s how most federal judges viewed it. Well…no. Researcher Clayton Cramer at PJ Media notes that state courts always treated it as an individual right, and federal judges had little to say because there were no federal gun laws, because of…well, the Second Amendment. Even the 1939 Supreme Court case that Stevens cites didn’t agree with him. So why did Stevens write this book? Well, retired football players miss playing football. Maybe retired liberal judges just miss rewriting the Constitution.
