Justice delivered, the vicious cycle : The blame game continues. A aam aadmi travails for justice as I have seen it. A man was seeking a lawyer to fight his case which had been closed unfairly against a accused by the I.O of the police for reasons best known to all. Going by the facts of the case it was a clear cut case which was deliberately messed up and protect the wrong doer, which means the next step approach the courts of law. Now comes the second part of struggle, a lawyer finally engaged through a known common friend. The initial approach of the lawyer would put even a seasoned marketing professional to shame in terms of the exemplary words and sentences jutted by the lawyer. Now begins the court yatra…yes yatra because now the client chases the lawyer who becomes elusive all of a sudden and occasionally when ever the meet happens by god’s grace….it will be do not worry Sir, I will take care of it, you are seeing how the system works. Ooops now blame on the system does it mean a additional moolah being demanded in ambiguity. Yup it has many meanings depends on the mood and time/place of the lawyer. Today is the 15th day the said client is pursuing the case…innumerable calls,sms’es of which only 0.05% answered by the lawyer. Definitely the court premises and Hospital are the ones any person would definitely try to avoid in his life time in Indian courts. I cannot blame the judges because judges deliver judges..and am not privy to other things in a judge’s life. Finally I joined my colleague to be at the courts to do a full day chase study of the environment. Yes it was resembling like a very busy busy place with lawyers and clients engaged in discussions some seriously and some in laughter mode. There was the canteen which the lawyers had the self declared privilege of asking the client for a cuppa coffee/tea and there are some who ordered snacks also ….oh my pity the client for this type of extortion. Next part is the official administrative set up in the precincts. This is usually visited by lawyers to get the case admitted and other details pertaining to orders etc etc. This section is not visited by the Aam aadmi because of the unknown protocol in getting things. Now I know some people are reading different things and I wont plunge more into these issues. And it was coming to the close of the day…and as usual my client waiting for his advocate like a person doing tapas(meditation) in the hope that god will answer his prayers. What I deduced from his travails are that we need a citizens charter imbibed for advocates also, which make it must that they complete a given case in a limited time. And mind you this case was a very very small/trivial one, but in the name of justice the colleague decided to fight it till the end. His first fight I am sure will be the last going by the sequences he had to undergo. And to make it more transparent and accountable all administrative offices within the court complexes should be hooked to live cameras so that the aam aadmi also knows the work that is being done in these sections. Ordinary people like me are definitely struck with dismay..when advocates blame the system is such and we as a individual cannot put up a protest. Apex court and High court judges have often goaded the advocates and lower courts to do a professional and honourable work of the profession they are into. But the reality is things have not changed significantly for the better to mitigate the hardship of common man in approaching lawyers/courts. People fear approaching the police, the courts should not become one such is my fervent prayer.
