Justice for Brandon and questions we hope the Toronto Police will address Larry Hurd Barrie Jun 25, 2014 — Dear supporters of Brandon, Im sure many of you will have heard the good news that thanks to our efforts the Toronto Police will be conducting the 3rd party review of the investigation into the tragic death of Brandon Majewski. Were pleased the review is happening, and have every expectation it will be conducted transparently and that the truth will be uncovered. Since that night in October 2012 there have been questions about what exactly happened, and about the police work that followed. Its all the more important that this investigation bring out the truth so the Majewski family can defend itself against the $1.35 million countersuit brought by the driver Sharlene Simon against Brandons estate for her pain and suffering for having hit him. Below are a few examples of outstanding questions that we believe the Toronto Police review should address. Even if some of the following actions are acceptable according to police protocol, they are nonetheless concerning and raise many questions that the public has the right to expect answers to. As well, please join and LIKE the Justice For Brandon Majewski Facebook group at https://facebook/justiceforbrandonmajewski where well be posting updates on Sharlene Simons lawsuit against Brandon, his two friends who were with him that night and the county of Simcoe. Unanswered Questions: · Why were Sharlene and Jules Simon allowed to leave the scene shortly after the accident while other witnesses were required to stay? Witness Melanie Lachance and the two other cyclists Jamie Cannon and Jake Roberts and Jakes mother Cindy Roberts were required to remain at the scene until after 5am, while Sharlene who was driving the car that hit Brandon was allowed to leave soon after EMS arrived. · Why were Sharlene Simons cell-phone records not requested? She admitted to police that she was distracted because she was adjusting her seat warmer. When an accident results in a fatality and the driver admits they were distracted it seems natural that cell phone records of the driver would be examined to check if that could have been a possible distraction as well at the time of the accident. · Why were witnesses Melanie Lachance and Jamie Cannons statements not included in the police report? The statements from Melanie Lachance and Jamie Cannon contradict what was included in the police report. For example, they say that at the time of the accident the road was dry and the moon was bright. It would appear that these two witnesses should be re-interviewed and their claims should be looked into. · Was Jules Simon required to give a statement? If so, where is it and why was it not included in the police report? Melanie Lachance who was driving the 3rd car was questioned. Jules was driving the car immediately behind Sharlenes. It seems natural that he would be questioned as well. · Why did Jules Simon, an off-duty York Regional Police Officer on scene, not offer to assist the injured boys? According to the Highway Traffic Act: 200. (1) Where an accident occurs on a highway, every person in charge of a vehicle or street car that is directly or indirectly involved in the accident shall, (a) remain at or immediately return to the scene of the accident; (b) render all possible assistance; and (c) upon request, give in writing to anyone sustaining loss or injury or to any police officer or to any witness his or her name, address, drivers licence number and jurisdiction of issuance, motor vehicle liability insurance policy insurer and policy number, name and address of the registered owner of the vehicle and the vehicle permit number.
