K-1 Basic process for those who are new to the K-1 visa process • File your application package I-129F and supporting documents • After about 30 days you will get a NOA1 (notice of action #1) this means that they did accept your application, (you signed it and paid the fee) • About 6-9 months later you will get NOA2 your approval notice, application has been approved. o NOTE: you could or could get a Notice that they did transfer your case if so you can expect an approval within 30 days (usually). o RFE- Request for Further evidence, they will send you this notice when you failed to include it in the application package. o NOID—Notice of Intent to Deny, they have reason to deny your application but are giving you a 2nd change to prove your case. • After NOA2 your case will be sent to the NVC (national visa center) there they will process assign it a case number the first 3 letters will be the embassies name ie MNL, this is referred to as a MCN (Manila Case Number) o You can call the NVC about 4 weeks after you get your NOA2 and ask for your case number some call every day or once a week o Or you can wait for the letter to come in the mail. • Once you have your case number you can pay your visa fee, schedule your interview and then go to your medical. • Medical is to ensure you do not have TB and get your shots etc. • At the interview you must prove your sponsor can support you financially and prove you have a bona fide relationship. • Once you get your visa, you will have 6 months from the date of your medical to enter the U.S. • After entering the US you will have 90 days to marry, YOU MUST MARRY WITHIN 90 DAY!! And you must marry the person who petitioned you if you do not do either of these you can not become legal in the US. • After marriage you file AOS (adjustment of Status) to change your status from Non-immigrant K-1 to a lawful conditional permanent resident (green card holder) 2 year green card holder. • 90 days before your green card expired you file for removal of condition’s and get your 10 year green card. • US citizenship can be applied for after 3 years of marriage to a US citizen or 5 years as a green card holder. • As a green card holder you are restricted from traveling outside the US for long periods of time (more than 6 month) or to many long trips, remember it is a permanent resident card not a come and go as you please card,
