KICINSKI FOR CONGRESS KicinskiForCongress For Immediate Release May 1, 2014 Contact: Michael Kicinski (315) 691-4906 Information@KicinskiForCongress The New York State Board of Elections has ignored election law and invalidated the designating petition for Candidate Michael J. Kicinski, Sr. for Member of the United States House of Representatives, 22nd Congressional District, State of New York. The NYS BOE failed to enforce or comply with election law 6204.1 (b). The NYS BOE considered and accepted objector specifications of objections contrary to election law 6204.1 (b). Election law 6204.1 (b) states in clear language that the board not consider objectors specifications of objections unless three conditions are met. The three conditions of election law 6204.1 (b) for the board to consider objectors specifications of objections were not met. The objector 1) did not personally deliver or mail by registered or certified mail a duplicate copy of the specification to the candidate for public office named on the petition, 2) did not deliver a copy of specifications of objections to the candidate on or before the date of filing of any specifications with the board, and 3) the objector did not file proof of such delivery of the copy of specifications of objections by end of business two days after specifications of objections due date. The NYS BOE wrongly accepted a certified mail receipt as proof of service that 1) does not match the certified mail item that was mailed to a person other than the candidate for public office named on the petition, 2) that does not show proof of service as defined by law and the NYS BOE as proof of such delivery, and 3) does not show any date of such delivery or receipt on or before the date of filing. As such, the objector failed to meet election law requirements and deadlines. Subsequently, the certified mail item was returned to sender as the named addressee on the item was not the candidate or any other person that resides at the address. The NYS BOE ignored statements and documents made and presented in paper by the candidate Michael J. Kicinski, Sr. Kicinski was told the documents were placed in his public record file containing the designating petition. All information and proof of non-compliance of election law 6204.1 (b) by the objector stated is supported by facts and documents. Because the objector did not comply with election law 6204.1 (b), the specifications of objections and time to contest were not made available to candidate Kicinski as prescribed by law. The NYS BOE has based their decision to invalidate the designating petition of Michael J. Kicinski, Sr. by ignoring election law, rules and regulations, procedures, deadlines, and documented facts. Many designating petitions in the past and even this election cycle have been validated though specifications of objections were sent but deadlines were not met. This is also the case for the designating petition of Michael J, Kicinski, Sr. The NYS BOE law requirements 6204.1 (b) were not met. No specifications of objections should have been considered. The designating petition of Michael J, Kicinski, Sr., under NYS BOE law requirements 6204.1 (b) and supported by documented evidence, is valid. The Kicinski for Congress campaign has continued to follow through to support the nomination and is looking at options to continue. While it is sure that many are rejoicing that Kicinski has been knocked off the ballot, the same people should be outraged that a government agency did not enforce or comply with the same law that was to afford equality and fairness in the election process. In a state that is ripe with reports of government corruption, this is exactly the type of thing the people have been fighting.
