LB Bork via Paul Trinca Nice post find and post by Jared Dalen and additions by Paul Trinca. WOW. Listen to the first 13 seconds, it is the only important part of Obombyas response. He is asked his thoughts on the constitution, but replies instead by specifically referencing the original constitution AND the civil war amendments (14th amendment included). Perhaps this is because the original constitution is not the same one as the one we live under today (post civil war)? Why else refer to it as a separate, seemingly dead document that has been replaced by something else? Isnt the Constitution one document that exists perpetually as it is amended (therefore being simply, the constitution)? After a normal rule change in the NFL, does anyone refer to the NFL as the original NFL regarding things that happened before the rule change? Probably not, since the league hasnt been REPLACED by another league. ...However, we dont refer to the AFL as the NFL, because the NFL REPLACED the AFL. The only time people differentiate with the word original is after its been replaced. Want more proof? We have held also that in adopting the Fourteenth Amendment, the people required the States to surrender a portion of the sovereignty that had been preserved to them by the ORIGINAL Constitution, so that Congress may authorize private suits against nonconsenting States pursuant to its § 5 enforcement power. Fitzpatrick v. Bitzer, 427 U. S. 445 (1976). By imposing explicit limits on the powers of the States and granting Congress the power to enforce them, the Amendment FUNDAMENTALLY ALTERED the balance of state and federal power struck by the Constitution. Seminole Tribe, 517 U. S., at 59. When Congress enacts appropriate legislation to enforce this Amendment, see City of Boerne v. Flores, 521 U. S. 507 (1997), federal interests are paramount, and Congress may assert an authority over the States which would be otherwise unauthorized by the Constitution. Fitzpatrick, supra, at 456. --527 U.S. 706 (1999) ALDEN et al. v.MAINE Bombya knows the truth, and love him or hate him, hes playing everybody like a fiddle. KNOW LAW OR NO LAW
