LHC suspends CDGL notification to ban construction around Jati Umra The Lahore High Court (LHC) on Monday suspended implementation of a notification issued, allegedly to favour the PML-N leaders, by the City District Government Lahore (CDGL) to ban all kinds of urban construction in the area surrounding Jati Umra. Justice Syed Mansoor Ali Shah issued the stay order on a petition filed by Advocate Noshab A Khan, who submitted that the CDGL, on March 1, 2013, had issued a notification after which 2000-acre land around Jati Umrah was frozen with respect to development of new housing schemes by all public and private agencies. The area, he said, could not be used for any construction purpose in future besides agricultural purposes. He said the attempt to cordon and earmark the subject area was indeed declaring the said area as an entire state for those political figures who were inhabitants of Jati Umra.The notification was a sheer violation of the fundamental rights of the people living in the cordoned area or having their underdeveloped housing colonies, the lawyer added. “The plan of the impugned notification is to stop the land owners of the cordoned area from constructing their homes. The impugned plan factually restricts the owners to simply grow vegetables or crops.” He contended that the notification and demarcation of the area cordoned was not based upon any section of the approved master plan of Lahore. He pointed out that revenue officers had been directed to seek no objection certificate (NOC) before passing any mutation in favour of any housing scheme which meant the notification had been issued to accommodate some blue eyed personalities of Jati Umra’s politicians. The petitioner requested the court to declare the notification as illegal and unconstitutional. After hearing arguments at length, the court suspended the impugned notification and sought replies from the Punjab government and the Lahore Development Authority (LDA) by July 4. images.thenews.pk/02-07-2013/ethenews/e-187241.htm
