#Libya Constitutional Department of the High Court: We are of the view that the election of Maitigs government was tainted with violations and breaches of the rules and procedures of the GNC. The second deputy GNC chairmans presiding over the meeting occurred in an unlawful manner as there was no reason to prevent the first deputy chairman to preside over the meeting. It was impermissible for the GNC chairman Abusahmain to sign approving the election because he was not present in the meeting and did not preside over it. A ruling to decide on the annulment of the election is the jurisdiction of administrative judiciary. The Constitutional Department role is limited deciding on the issue regarding the GNC decision to adopt the described mechanism and not the 120 vote quorum. The Constitutional Department finds that in violation of the Constitutional Declaration and deems it unconstitutional. It is worth noting that the decision is not binding for the court but it is usually in agreement with it. الدائرة الدستورية للمحكمة العليا : الان في جلسة الدائرة الدستورية للمحكمة العليا للنظر في الطعن المقدم ضد انتخاب حكومة امعيتيق قدمت نيابة النقض مذكرة برأيها وترى ان إجراءات انتخاب حكومة امعيتيق شابها البطلان ومخالفة للأئحة الداخلية للمؤتمر الوطني العام وان ترأس النائب الثاني تم بطريقة غير قانونية لانه لايوجد مانع يعوق دون ترأس النائب الاول وان توقيع السيد رئيس المؤتمر على انتخاب امعيتيق غير جائز لانه لم يحضر جبسة الانتخاب ولم يترأسها و ان القضاء ببطلان ذلك من اختصاص القضاء الاداري وينحصر دور الدائرة الدستورية في الفصل في قرار المؤتمر بجعل الانتخاب بالآلية الموصوفة وليس بنصاب 120 صوت وترى نيابة النقض ان ذلك مخالف للإعلان الدستوري المؤقت وترى بعدم دستورية التعديل والجدير بالذكر ان رأي نيابة النقض ليس ملزم للمحكمة لكنه في الغالب ما يكون متفقا مع حكم المحكمة والآن رفعت الجلسة للاستراحة والقرار اخر الجلسة .
