MORE QUESTIONS FOR THE MAN ON THE HOT SEAT TO ANSWER Maa-Counties’ Advanced Education Network POB 1802-00200 NAIROBI, KENYA Tuesday 2nd September, 2014 To His Excellency Dr David Nkedianye AN OPEN LETTER TO H.E GOV DAVID OLE NKEDIANYE RE: KAJIADO COUNTY PUBLIC SERVICES BOARD/KCPSB ALLOWING MCAs TO PATRONIZE THE PROCESS OF HIRING THE WARD ADMNISTRATORS Maa-Counties Advanced Education Network is a common man initiative/movement that lobbies for the advancement of education among the Maasai Counties in Kenya. On (Friday 29th August 2014) in the D.N Newspaper the KCPSB displayed in a paid up advert names of those shortlisted for the positions of ward administrators from the various wards in the county. We are irked by the fact that this advert and others that went before it are mere public relations exercises, a serious abuse of the legal process and improper hiring practises, simply because the KCPSB has already cut out deals with some MCAs to circumvent the law and only dish out these positions to those canvassed for by the MCAs. This act and/or intend has not only jeopardized competence but also compromised beyond repair the beauty of meritocracy and fair competition. Over and above violating every law of the land and natural justice this act / attempt/ intent by your board fatally injures the provisions of our Constitution i.e. the article on fair administrative action (Constitution of Kenya–Article 47 (1) Every person has the right to administrative action that is expeditious, efficient, lawful, reasonable and procedurally fair. (2) If a right or fundamental freedom of a person has been or is likely to be adversely affected by administrative action, the person has the right to be given written reasons for the action.) It’s now in the public domain that graduates with various degrees are being surpassed in favour of their counterparts who hold diplomas or lesser qualifications as they are the favourites of the patrons of the hiring process (read MCAs). We raise a number of fundamental issues and hereby bring to your attention the following; 1. If the KCPSB has cut deals with the MCAs, should this be done at any cost to the public and the taxpayers of Kajiado County? 2. If the few MCAs must have their way because they have become a law unto themselves then why waste scarce public resources to advertise, invite, shortlist and then perform a sham exercise that leads to nothing but to a predetermined lowly outcome. 3. Why should some members of KCPSB publicly declare that such positions belong to MCAs and that any one at disfavour with them is to consider themselves unlucky & unsuccessful? 4. That your PSB are in possession of a list of 25 ‘preferred candidates’ some less qualified but will eventually clinch the jobs against their compatriots who hold degrees, possess greater experience, and have better standing on matters integrity. Your Excellency, it’s our humble submission that this fraud and terrible travesty of justice does not only rob this county of competent and intelligent resources but also visits immense injustice on our county and defeat the purpose and spirit of devolution. You must therefore impress upon your board that such practice is unacceptable and if need be you veto the entire exercise and demand that the board re-advertise the positions and for those with vested interests should, as a matter of public interest disqualify themselves from sitting in the interview panels. To be fair to you be notified that we have raised this matter with other relevant national authorities who will be ready to spring to action once this fraud crystallizes. We have submitted names from a number of wards of the preferred candidates a majority of which only possess diplomas and other lesser qualifications by the date of the closure of the job adverts. We note with utter dismay that there was also a deliberate conspiracy between the some MCAs and some members of your board to delay the recruitment exercise to allow a particular preferred candidate to complete his degree course. A shameful example is the late submission of degree completion letters by the preferred candidate for Keekonyokie ward and the same were collected in person by a senior member of the PSB to be slotted into his academic papers as this fellow have been assured of clinching the job despite the fact that by the time of closure of the advertisement he was still a diploma holder unlike his competitors who hold degrees and with substantial requisite experience. Indeed there is an un-clever conspiracy to rank very low the undesired candidates and rank very high the favoured candidates even when papers and experience do not support the rankings awarded. Mr Governor we will never accept this outdated favouritism that is not only stale but a practice of yesteryears that is only heard of in County No. 34 in Kenya. No one is above the law. The most affected wards are: Keekonyokie ward Dalalekutuk ward Purko ward, and Ildamat ward. This however does not exonerate any other ward not mentioned above from attempting to compromise the process and quality of candidate fronted by KCPSB in cahoots with the select MCAs. Your Excellency our demands are as follows; 1) That the board discloses the names of ALL APPLICANTS to these positions on a ward by ward basis and not just the doctored shortlist which in itself is a sham exercise. 2) That the board opens for public input and participation the scrutiny of these candidates for this has become a tenet and hallmark of every publicly funded recruitment. 3) That the board should not violate its own precedent which was set and followed during the hiring of chief officers particularly for education where masters degree was given pre-eminence over a first degree where the two were on the table. In this case of ward administrators a degree should have pre-eminence over a diploma or a higher diploma. 4) That proper consideration in this particular category of county employees should address itself to gender parity and also the inclusion of special interest groups.
