MUTHU YANG BAIK SAYS... Six people in Taiping are claiming that although they had paid for their houses in full, their properties will be auctioned off – by a foreign debt collection agency. Here’s what they say: • They bought double-storey houses costing RM139,900 in Taman Suria Permai from KS Properties and lawyer Tan Hooi Meng acted on the developer’s behalf. • KS Properties proprietor was Koi Kim Seng had asked Tan Tan to collect the house payments on his behalf. • The owners made full payment to but were not given the title deeds. • They kept pestering Tan and Koi but nothing came out of it. They threatened to sue Koi in 2008 but he asked them not to. • A few months later in 2008, Koi was found dead at his home and the company wound up. • KS Properties had earlier charged the houses to a bank. The bank was recouping its losses by selling the non-performing loans to a debt collection agency called Gale Force. • Gale Force filed a case at the Ipoh High Court last year to recoup its losses from eight house owners. There was to be a trial. • Lawyer Tan Hooi Meng was supposed to testify at the trial. But two weeks before he was to testify, his body was found near a hotel in Taiping on 2 December 2012. manage.mmail.my/story/npl-case-key-witness-dead-41048 • [Not sure what has happened to the case in the Ipoh High Court. However, the owners filed an injunction in December against the auctioning off of their properties which was to be done in January, but this was removed by the Taiping Court.] • Gale Force had, apparently, tried to force them out of their homes by cutting off their power and water supply in July,2013, but state consent is needed to do this – which Gale Force did not have. • Gale Force is foreign-owned and for debt collection firms to operate in Malaysia, they need to be locally owned. • Gale Force’s lawyers are Shook, Lin and Bok.
