MY IMMIGRATION APPLICATION WAS DENIED BASED ON AN INCORRECT ANSWER IN MY VISA APPLICATION THAT MY FRIEND COMPLETED FOR ME, I WAS TOLD I NEED A MISREPRESENTATION WAIVER; IS THIS POSSIBLE? Answer: Whether or not you personally filled out you visa application, you used a friend, or a so-called immigration consultant, which you should never do, you are personally responsible for the information in your application. If it is incorrect, you are responsible. If the incorrect answer amounts to fraud or a material misrepresentation, you will be deemed permanently inadmissible. Saying you were not the one who completed the form is no defense to fraud or material misrepresentation. If you use a licensed attorney, you may be able to correct the information or be excused on grounds of ineffective assistance of counsel, but such a defense is not applicable when you use a friend, family member, or a consultant. Remember, you should personally review all answers in your application before it is submitted.
