MYTH NUMBER THREE (Continuation of Post Titled Myths Busted dated 19 Jan) We have an Independent and vibrant Judiciary which is there as a Forum for Conflict Resolutions. Judiciary in Pakistan has Never been Independent and Vibrant.Judiciary Remains to be one of the weakest link of our Society. Judiciary has always been and remains to be an Extended Arm of the Executive and the Government. The sad story of Judicial In activism started in 1954,when the then Supreme Court headed by late Justice M.Munir upheld the sacking of Khawja Nazim ud Dins Government by the then Governor General Ghulam Muhammad. That day till now Judiciary has been used by All Governments to its benefit. Judiciary is in fact a tool in the hands of the Government to pressurize its opponents and even Screw them. Judiciary has Validated All the Military Takeovers. Judiciary in Pakistan has the History of being taken and counted as the B Team of the Government. Corruption is so much Common in Judiciary that Al Amaan Al Hafeez We saw some Dramatic Developments related to Judiciary in the last few years.Sacking of Justice Iftekhar Muhammad Choudhry by General Pervez Musharaf in 2007 and resultant Movement for Restoration by Lawyers got lot of Public Support. The pressure of Public Support forced the then Government to restore the Judges in Mar 2008. People were happy and Expected that this will result in improvement in Judicial System, but very very Unfortunately this Whole Movement happened to be Politically sponsored,managed Drama. The Nation had to endure and digest an Ugly Drama in the garb of Judicial Activism for the next few years till the then Chief Justice finally retired in 2012. Everything is back to normal.The honourable Judges of Pakistans higher Judiciary hear no evil, see no evil. All is well. They can see dirty clothes hanging on the fence of Supreme Court but can not see and bother when Punjab Police kills seventeen people on the roads of Model Town Lahore.Likewise all other Government Excesses just do not matter,and are out of their sight. If we ever had a notion or idea that we have an Independent and Vibrant Judiciary which is alive to the problems faced by the People and is there to Resolve Conflicts and to Provide Justice, this Myth is Totally and Thoroughly Busted.
