Ma 7 and I were at it again! This time she gave me an in-depth analysis of the current and future dramas. It was so entertaining; I could not even take a deep breath in the manner she articulated the social and political scene in the country. Since she did an extra good job in her take of Mandonsela’s report, we wasted little time on this aspect. The weekend brief centred on, the bulking of political parties in the country, the soccer world cup and the on-going Oscar media trial. I wish i could write all she said but, i will be confined to express her views in the Oscar’s trial. Ma 7 began by disseminating the different forms of the court systems in South Africa and United States. Key was the need to understanding why, the South African system did not have a jury system in the country. The bench in our legal system does intentionally not cater for a jury system for a simple fact that, the tenets of the legal system should be endowed with knowledge that: it requires people who were well vested in the legal discourse and as such, the mentioned people would practice and exercise such in the deliberations of the verdict. This rich system of upholding the justice system as opposed to being fascinated by oral presentations, playing to the gallery and mere witty knots to convince the “uneducated” in the legal paradigm is inevitable in the jury system and hence Justice may be tailored to the battle of wits as opposed to the pursuit of the legal discourse. The South African system is rich and hence retains the virtues of law. The central issue that she was alluding to here, was questioning the rational of media’ s involvement in OP’s trial case which is a criminal case to the public gallery. She was of strong opinion that, the broader masses, inclusive of me: could at best, just institute common sense analyses, logical deductions that have little or no bearing to the legal fraternity. This she said was tantamount to the formations of Kangaroos court, mob justice and sometimes dictates the shape and content of the deliberations in the proceedings. Gees, i nearly fainted and though, the need to sound intelligent on my part was inevitable, i expressed the rational of this event as being of international and national interest, Oscar’s life is clearly of public’s interest. Wow the response just swiped me of my feet; she said, this is where one needs to understand the separations of power, between the Legal, and the political system and the need to promote democracy. The issue of OP was just one that has public hype, but it’s also confined within the legal parameters of the criminal justice system in South Africa, so yes, there would no deviations tolerated, however, opening it up to the public might as well, have the diming effect to the justice system as to the fact that, many social groupings have differing interest to the matter. People against Women Abuse have a stake to the matter, political parties have equally developed an interest, and the media has an interest in swaying the general perceptions of “justice of the rich”. So all this competing interest that are not, well endowed with the legal fraternity might jeopardise the ruling. Gees Ma 7, is really untouchable and now she is looking forward to becoming the President of the country and maybe she would give me her shares in the shebeen business. Nevertheless she gave a free round of Beer and still requested me to post this on FB, to attract customers outside of Rockville Soweto...........Business unusual in Kasi, and one wonders why such impeccable knowledge is left out of the mainstream academia and intellectual pool..............Jah Bless yeah.
