Mandatory sentencing laws hurting Louisiana Over the past several decades, Louisiana legislators have passed a number of mandatory minimum sentencing laws requiring judges to send low-level, nonviolent drug offenders to prison for long periods of time. Because of this, the state’s prison population has nearly doubled from roughly 21,000 in 1992 to 40,170 in 2012. Louisiana now has the highest incarceration rate in the country, with 868 of every 100,000 of its citizens in prison. The state’s growing prison population has brought soaring costs along with it.
