Many denials have some people asking if they should even bother filing for a Provisional Waiver. I think it is an excellent question. The bad news is that there does seem to be a high percentage of denials, and even the best attorneys are getting denials and there does not seem to be a way to tell which cases are likely to be denied because the decisions to not seem to have a pattern. I have to admit that I was wrong. I had said that I was 100% confident that a well-prepared attorney package would not be denied on the basis of "lack of hardship". However I have heard from attorneys that have had their well-prepared cases denied for lack of hardship. Furthermore, the cases denied were, in many cases, ones with good evidence. My honest opinion is that everyone should be working on their waiver package. This process typically takes a couple months to gather all the evidence needed. However, for many people, it might be best to hold off on mailing the package until we see some changes. I do still feel confident that once all the new adjudicators are trained, and they are not trying to sift through way too many cases in way too little time, that we will see a lot less denials. I also feel that there will be a change in policy on the "reason to believe" denials. On the other hand, if you want to file now, that is fine too. It is only money, and you will not be disadvantaged if you are denied and you want to apply again. Remember that while there have been a lot of denials, there have been a lot of APPROVALS too!
